Terms and Conditions

These Terms govern your use of the Qaekwy cloud-based API (the Qaekwy backend) (the “Service”). By using the Service, you agree to these terms.

1. Project Status

  • The Service is a personal, experimental research project, non-commercial, developed and maintained by an individual ("the Developer"). It may change or be discontinued at any time.
  • The Service is provided free of charge, under this Terms.

2. License & Acceptable Use

  • You are granted a limited, revocable, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

  • You may use the Service solely for non-commercial research, educational, or personal purposes, and only in compliance with applicable law.

  • You may not use the Service for any of the following:

    • Commercial purposes, including but not limited to using the Service in connection with products, services, or activities intended for profit, unless the Developer provides prior written consent.
    • Unlawful activities, including violation of any laws, regulations, or third-party rights (such as privacy, intellectual property, or contractual rights).
    • Harmful or unethical activities, including transmitting illegal, abusive, or offensive content.
    • Service disruption, including attacking, stressing, overloading, or otherwise interfering with the Service’s operation.
    • Reverse engineering, decompiling, or attempting to access the Service’s code, data, or algorithms.
    • Use in life-critical or safety-critical systems.
    • Misuse of resources in a way that disrupts or degrades access for others.

Violation of these restrictions may result in suspension, termination, or legal action.


3. Intellectual Property

Qaekwy Python Client

  • Released under the EUPL-1.2 License. You may use, study, modify, and redistribute it under that license.

Qaekwy cloud-based API (the Qaekwy backend) (the “Service”)

  • Proprietary. No rights to its software, code, or algorithms are granted beyond use under these Terms.

4. Availability & Termination

  • The Service is provided as an experimental service, with no guarantees of uptime, performance, or support.

  • The Service may be rate-limited, throttled, suspended, restricted, blocked, or terminated at any time without notice, at the Developer’s discretion. Upon termination, your access rights end and any temporary data will be deleted according to Section 6.


5. Liability & Indemnity

5.1 Disclaimer of Warranties

The Qaekwy cloud-based API (the “Service”) is provided “as is” and “as available,” without any warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement. To the extent permitted by applicable law, the Developer does not guarantee that the Service will be uninterrupted, error-free, or secure, or that defects will be corrected. You use the Service at your own risk.

5.2 Limitation of Liability

To the fullest extent permitted by law, the Developer and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages (e.g., loss of profits, data, or goodwill) arising from the Service, whether based on contract, tort, or other legal theory, even if advised of such damages. As the Service is free, the Developer’s total liability for any claims is limited to zero euros (€0). In jurisdictions where limitations for gross negligence or willful misconduct are not permitted, liability is limited to the minimum required by law.

5.3 User Responsibility for Data

You are solely responsible for the security, backup, and integrity of data you transmit or process through the Service, as well as ensuring compliance with applicable laws. The Developer is not liable for any loss, corruption, or unauthorized access to your data.

5.4 Indemnification

You agree to indemnify and hold harmless the Developer and its affiliates from claims, damages, or costs (including reasonable legal fees) arising from: (a) your intentional misuse of the Service; (b) your violation of these Terms; (c) your violation of applicable laws or third-party rights; or (d) data you process through the Service. This obligation applies to the extent permitted by law and survives termination of your use of the Service.


6. Data & Privacy

  • Minimal metadata is collected (timestamps, request size, frequency) and is deleted within maximum 30 days.
  • Problem data (modelling data) may be temporarily stored for computation/debugging and is deleted within maximum 30 days.
  • No personal data is collected or allowed. Submitting personal data is a violation of these Terms.

Hosting is in Germany with standard security protections.


7. Governing Law

  • These Terms are governed by French law and, where applicable, EU law (including GDPR). Disputes will be handled by the courts of Rennes (France), after a mediation.

8. Changes

  • Terms may be updated from time to time. If you continue to use the Service after changes to the Terms, you are deemed to have accepted the revised Terms.
